
The Collaborative Family Law process is a process that offers a structured and cooperative alternative to litigation and aims to assist families in resolving their disputes confidentially and efficiently. This process puts parties in control of their family matters and takes them out of court. It focuses on the creation of customized agreements that reduce conflict, promote open communication, preserve relationships, emphasizes the needs of children, and focus on their best interests.
Both parties must consent to the Collaborative Family Law process and enter into a Participation Agreement, where they commit to resolving their issues out of court. In the Collaborative Family Law process, parties agree to negotiate in good faith, commit to open and honest communication, agree not to proceed with litigation while the collaborative process is ongoing, and agree to share all relevant information and documents.
In the process, each party selects a Collaborative family lawyer to assist them with the process. Collaborative family lawyers act as advocates and problem-solvers, not opponents. They provide legal advice in the context of negotiation, not as a litigation strategy. They also ensure that the parties’ interests are considered and that the process is conducted in a transparent and respectful manner. In the event that the process fails, the Collaborative family lawyers are obliged to withdraw as counsel and cannot represent a party if the matter proceeds to court.
During the Collaborative Family Law process, the parties and their respective Collaborative family lawyers will meet to discuss each issue and work toward solutions. The parties may agree to appoint other Collaborative professionals, such as a financial professional, family specialist, or divorce coach, to help address a specific concern or issue. When all issues are resolved, the Collaborative family lawyers prepare a legally binding agreement and assist the parties with the preparation and filing of any necessary court documents.
